The bottom line is, you've talked a lot, but you've shown nothing other than that you don't think people should be individually accountable for their own criminal actions and that you don't care whether or not 13 years of administration, teachers and student body are unjustly punished for someone else's crimes. "Well, the punishment won't effect the innocent people THAT much, right?" Wonderful rationalization.

This ridiculous NCAA ruling is a travesty. It tramples on Blackstone's proverb: “Better that ten guilty persons escape, than that one innocent suffer.” I'd lay dollars to dimes you'd sing a different tune if you ever ended up having to abide the abusive ruling of a judge or an administrative body that has the same kaleidoscopic view of justice that you do.

• The NCAA did not give Penn State trustees and the university due process when it did not follow its usual investigation and enforcement procedures.

• The consent decree is fundamentally unfair because it relies on the Freeh report, which "contains findings and conclusions not that are contrary to the evidence presented ..."

• The sanctions are "excessive and unreasonable" because they inflict "permanent damage to an entire generation of student-athletes and coaches who were innocent of any wrongdoing during their time on campus ..."

My question is now this: The NCAA already went ahead and broke the mold with the way punishment was handed down to PSU, thus the biggest reasoning behind the appeal. There was already talk about the death penalty being the alternative option if the penalties weren't agreed to. Could that still be in play?

It's a hell of a question.

The last point is a moot one, as far as I'm concerned. All the penalties are in accordance with what the NCAA handbook says the NCAA can push against an institution (page 335 of the handbook).

The due process part is one that I'm having a hard time getting in the handbook. The only "due process" mention is that when it pertains to a coaching staff member:

The affected coaching staff member must be given through the appropriate institution notice of an opportunity to be heard at both the NCAA hearing resulting in the finding of involvement in the violation and the institutional hearing resulting in suspension or prohibition. I'm not sure where they get that the institution as a whole gets a due process, but given how retarded they are with the "severe punishment" portion, it seems like they're just grasping at straws.

From what I've gathered, the NCAA, went about their business justly and by their handbook.

I have not seen anyone so good at mental gymnastics that they could call other people stupid after spending days sticking up for someone that allowed a child rapist to walk free for years after knowing that person was a child rapist. It was so obvious to anyone with a half a brain that Paterno could have done more but you go ahead and tell yourself that it is the other people that condemned him who are stupid. Just don't expect anybody to buy that garbage.

Did you even read my entire post? Did you digest it before you responded? I admitted I was wrong. That's like the first point I made. But it's also pretty easy to point fingers at people who were wrong when all the facts finally come out. My stance in November was based on all the facts we knew at that point, which was basically that Paterno reported to the head of police what he heard and that Paterno was told it was being taken care of. Yeah ok, Paterno could have done more. Strangling Sandusky with his own hands is doing more. But that's not the point. The point is the court of public opinion was ready to jump the gun from every angle because they wanted so badly to see an idol fall. Well, now we know there was indeed a coverup, and Paterno was involved to at least some extent, so all you guys got your wish. I ended up being wrong when all the facts came out, and Paterno helped fukk things up at Penn State big time. His legacy is tainted and he deservedly got an unceremonious boot from the school.

And way to spin my analogy around to try to make it sound stupid. You obviously didn't understand it. I'm saying that jumping to brash conclusions before letting things develop is stupid. I'm not comparing raping children baseball. Where did you even come up with that?

Anyway, this is the last I'm saying on this topic, as the whole thing is full of negative energy and still seems surreal after nine months. Everyone who was involved and is still alive is going to get what he deserves.
